1. Introduction

Welcome to Shougl platform. These Terms & Conditions (the "Terms") govern your access to and use of the Shougl platform website at https://shougl.com (the "Site"), which is operated by tanfidh alkhadamat almadarah Company Ltd. ("Tanfeth", "we", "us", or "our"), a limited liability company registered in the Kingdom of Saudi Arabia under Commercial Registration / Unified National Number 7051941628, with its registered office at Al Ezdihar District, Abdullah Ibn Saud Ibn Abdulaziz Branch, Riyadh, Kingdom of Saudi Arabia. Shougl (شغل) is the trading name under which we operate a recruitment marketplace connecting employers in Saudi Arabia with workers seeking blue-collar and grey-collar roles.

These Terms cover your use of the Site. They do not replace the separate terms of service that govern your use of the Shougl platform mobile applications, which must be accepted independently when you register an account in those applications.

PLEASE READ THESE TERMS CAREFULLY. By accessing the Site, browsing it, or submitting any information through its forms, you acknowledge that you have read and understood these Terms and you agree to be bound by them. If you do not agree to these Terms, please do not use the Site.

Tanfeth reserves the right to update these Terms from time to time at its sole discretion. The "Last updated" date above reflects the most recent revision, and your continued use of the Site after any change constitutes your acceptance of the updated Terms. We recommend reviewing this page periodically.

2. Definitions

For the purposes of these Terms, capitalised terms shall have the following meanings:

  • "Shougl platform" means the recruitment marketplace product operated by Tanfeth, including the Site and any mobile applications published under the Shougl platform name.
  • "Site" means the public-facing website at https://shougl.com, including any subdomains.
  • "Employer Application" means the Shougl platform mobile and/or web application designed for businesses that wish to post jobs and review applicants.
  • "Job Seeker Application" means the Shougl platform mobile application designed for individuals seeking employment.
  • "Employer" means any business or individual using Shougl platform to post or fill jobs.
  • "Job Seeker" means any individual using Shougl platform to find work.
  • "User", "you", or "your" means any person who accesses or uses the Site, whether as an Employer, a Job Seeker, or a casual visitor.
  • "Content" means any text, image, video, form submission, or other material made available on or through the Site.

3. Eligibility

To use the Site you must be at least eighteen (18) years of age, or the age of legal majority in your jurisdiction, whichever is higher. By using the Site you confirm that you meet this requirement and that you are legally able to enter into a binding agreement.

If you submit information on behalf of a company or other legal entity, you represent and warrant that you are authorised to do so and that you bind that entity to these Terms.

4. The Service

The Site is an informational and marketing surface for the Shougl platform product. Through the Site you may, among other things:

  • Read about Shougl platform's features, pricing, and supported job categories;
  • Submit a contact form, request a demo, or sign up for product updates; and
  • Be directed to download the Employer Application or the Job Seeker Application from the Apple App Store, Google Play, or Huawei AppGallery, or to a separate web application.

Tanfeth is not an employer of any worker registered on Shougl platform, an employment agency, or a recruitment consultancy. Shougl platform provides a technology platform that allows Employers and Job Seekers to discover and contact one another. All decisions to hire, accept work, set wages, or terminate any working arrangement are made entirely by the parties involved and not by Tanfeth.

5. Information You Submit

When you submit a form on the Site (including but not limited to a demo request, contact form, or waitlist sign-up), the data you provide is sent to systems operated by Tanfeth or its service providers and is processed in accordance with our Privacy Policy.

You represent and warrant that any information you provide is true, accurate, current, and complete; that it relates to you (or to a legal entity you represent and have authority to provide details for); and that you are not impersonating any person or entity.

6. Acceptable Use

You agree to use the Site lawfully and in good faith. In particular, you shall not:

  • Use the Site in any manner that violates Saudi law or any other law applicable to you;
  • Attempt to gain unauthorised access to the Site, its underlying servers, or any related systems;
  • Probe, scan, or test the vulnerability of the Site or breach any security or authentication measure;
  • Use any automated tool (including scrapers, crawlers, robots, or AI agents) to extract content from the Site at a rate or scale that may interfere with normal operation, except for general-purpose search engine indexing;
  • Submit information that is false, misleading, defamatory, or that infringes the rights of any third party;
  • Upload or transmit any code intended to disrupt, damage, or limit the functionality of the Site or any device;
  • Use the Site, or any data obtained from it, to build a competing product or service; or
  • Reproduce, copy, or republish any portion of the Site beyond the limited use described in section 7.

7. Intellectual Property

All content on the Site — including without limitation the Shougl platform name and logo, the Tanfeth name, page layouts, illustrations, written copy, photographs, and the underlying code — is the exclusive property of Tanfeth or its licensors and is protected by intellectual property laws.

Subject to your compliance with these Terms, you are granted a limited, personal, non-exclusive, non-transferable, revocable licence to view the Site for your own informational purposes. No other right is granted. In particular, you shall not:

  • Reproduce or distribute Site content for commercial purposes;
  • Frame the Site within another website without prior written permission;
  • Remove any copyright, trademark, or other proprietary notice; or
  • Use any Shougl platform or Tanfeth trademark in a manner that suggests sponsorship or endorsement that does not exist.

If you provide feedback, suggestions, or ideas regarding Shougl platform through the Site (collectively, "Feedback"), you grant Tanfeth a worldwide, royalty-free, perpetual, irrevocable, sublicensable licence to use, reproduce, modify, and incorporate that Feedback to operate and improve the product, with no obligation of confidentiality and no compensation owed to you.

8. Third-Party Links and Services

The Site may contain links to third-party websites, services, or resources (for example, app store listings, social media pages, or partner sites), which are provided for convenience only. Tanfeth does not control these third parties and shall not be responsible for their content, products, services, or privacy practices. Your use of any third-party service is governed by that third party's own terms.

9. Disclaimer of Warranties

THE SITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITH ALL FAULTS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TANFETH AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, AND NON-INFRINGEMENT.

WITHOUT LIMITING THE FOREGOING, TANFETH MAKES NO WARRANTY THAT: (A) THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (B) ANY DEFECT IN THE SITE WILL BE CORRECTED; (C) THE SITE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR (D) THE INFORMATION ON THE SITE IS CURRENT, ACCURATE, OR COMPLETE IN EVERY RESPECT.

Pricing, feature descriptions, and product capabilities shown on the Site are subject to change without notice. The version of any application that you download may differ from screenshots or descriptions on the Site.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TANFETH OR ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST REVENUES, LOST BUSINESS, LOST DATA, OR BUSINESS INTERRUPTION, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT TANFETH HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN ANY EVENT, THE TOTAL AGGREGATE LIABILITY OF TANFETH ARISING OUT OF OR RELATING TO THE SITE SHALL NOT EXCEED FIFTY SAUDI RIYALS (SAR 50) OR THE EQUIVALENT IN ANOTHER CURRENCY. THIS LIMITATION REPRESENTS AN ALLOCATION OF RISK BETWEEN YOU AND TANFETH AND APPLIES REGARDLESS OF THE FORM OF ACTION.

Nothing in this section shall limit any liability that cannot, by applicable law, be excluded or limited.

11. Indemnification

You agree to indemnify, defend, and hold harmless Tanfeth, its affiliates, and their respective officers, directors, employees, and agents from and against any claim, demand, loss, liability, damage, cost, or expense (including reasonable legal fees) arising out of or relating to:

(a) your access to or use of the Site;
(b) your breach of these Terms;
(c) any information you submit through the Site that is inaccurate or that infringes the rights of any third party; or
(d) your violation of any law or regulation.

12. Termination

Tanfeth may, in its sole discretion and without prior notice, restrict, suspend, or terminate your access to all or any part of the Site if it believes you have violated these Terms or any applicable law. Sections of these Terms that, by their nature, are intended to survive termination — including those covering intellectual property, disclaimers, limitation of liability, indemnification, governing law, and dispute resolution — shall continue to apply.

You may stop using the Site at any time.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia, without regard to its conflict-of-law principles.

Any dispute, controversy, or claim arising out of or relating to these Terms — including any question regarding their existence, validity, or termination — shall be referred to and finally resolved by arbitration administered by the Saudi Center for Commercial Arbitration (SCCA) in accordance with its Arbitration Rules in force at the time of submission of the request for arbitration. The seat of arbitration shall be Riyadh, Saudi Arabia, and the language of arbitration shall be Arabic.

14. General Provisions

Entire Agreement. These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Tanfeth regarding the Site and supersede any prior agreements between the parties on the same subject.

Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid provision shall be interpreted to give effect to the parties' original intent to the extent permitted by law.

No Waiver. No failure or delay by Tanfeth in exercising any right under these Terms shall operate as a waiver of that right.

Assignment. You may not assign these Terms, in whole or in part, without Tanfeth's prior written consent. Tanfeth may freely assign these Terms, including to an affiliate or in connection with a merger, acquisition, or sale of assets.

Force Majeure. Tanfeth shall not be liable for any delay or failure caused by events beyond its reasonable control, including without limitation natural disasters, war, civil unrest, pandemic, government action, or failures of public infrastructure.

Electronic Communications. You consent to receive communications from Tanfeth electronically, including by email, and you agree that all agreements, notices, and disclosures provided electronically satisfy any requirement that they be in writing.

Language. This document is provided in both English and Arabic. In the event of any discrepancy between the two versions, the Arabic version shall prevail to the extent required by Saudi law.
