1. Services

Shougl connects employers with job seekers in the blue- and grey-collar workforce sector across the Kingdom of Saudi Arabia and the MENA region. The platform enables employers to publish job listings, review applications, and access the data of candidates suitable for their hiring needs.

2. Use of the App & Services

2.1 Application License

tanfidh alkhadamat almadarah Company Ltd. grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a device you own or control, solely for your legitimate internal business purposes in accordance with these Terms. When using the App via the Apple App Store, you agree to comply with Apple's Usage Rules in its Terms of Service; when using it via Google Play, you agree to Google Play's applicable terms.

2.2 Updates

The Company reserves the right to update the App and develop its services periodically, with or without prior notice. Your continued use of the App following any update constitutes implicit acceptance of the changes made.

2.3 Restrictions

You may not, under any circumstances:

  • Sell, rent, transfer, redistribute, or commercially exploit the App outside its intended purpose.
  • Modify, reverse engineer, or create derivative works from the App.
  • Use automated tools to collect data or scrape content from the platform.
  • Build a competing or similar service using the platform's data or materials.
  • Remove any proprietary notices or trademarks from any part of the App.

2.4 Third-Party Materials

The Service may include access to resources hosted by third parties. You acknowledge and agree that the Company has no control over such materials and that your use of them is entirely at your own risk.

3. Registration

3.1 Account Creation

Account creation is free for all employers. The Company reserves the right to reject any registration request or suspend any account without stating reasons. You may not register more than one account or create an account on behalf of another party without explicit authorization. If your account has previously been suspended or banned, you may not create a new account.

3.2 Registration Data

You undertake to provide the Company with accurate, complete, and continuously up-to-date information including: business name, commercial registration number, official contact details, and the name of the authorized legal representative. You are fully responsible for all activity conducted through your account and for maintaining the confidentiality of your login credentials, and must notify the Company immediately of any unauthorized use.

3.3 Equipment Requirements

You are responsible for providing the hardware and software necessary to use the App, including a compatible mobile device, and for bearing any associated internet connection costs.

4. Subscription & Fees

4.1 Pricing Structure

The Shougl platform operates a flexible pricing model built on two core components:

  • Job Posting Fee: charged per job posting published on the platform in accordance with the selected package.
  • Candidate Unlock Fee: charged per candidate whose full contact information and profile the Employer wishes to access.

Detailed pricing is displayed within the App and is subject to periodic updates. Continued use of the service constitutes acceptance of the applicable pricing.

4.2 Payment Methods

The App supports electronic payment methods approved in the Kingdom of Saudi Arabia. All payments are processed through secure, accredited payment gateways. Employers are responsible for applicable VAT in accordance with Saudi regulations. Credit card details will not be stored by the Company.

4.3 Free Account

Employers may create an account and browse the platform without a paid subscription. Future updates may enable job posting without a subscription; however, accessing and unlocking candidate data will in all cases require payment of the applicable fees.

5. Responsibility for Content

5.1 Types of Content

You are solely responsible for all content you publish through the App, including job postings, business data, and any other materials. Responsibility for this content does not transfer to the Company under any circumstances.

5.2 No Obligation to Pre-Screen Content

The Company reserves the right, but is under no obligation, to review, reject, or remove any content at its sole discretion and without prior notice. The Company bears no liability for any content or for claims of financial loss arising from it.

5.3 Storage

The Company is not obligated to store any content you publish on the App unless agreed to in writing. The Company reserves the right to impose reasonable limitations on usage and storage.

6. Access to Candidate Data

6.1 Employers may view the list of candidates who have applied to their job postings, with access to basic information at no charge.

6.2 Accessing a candidate's full contact details and profile requires payment of the applicable Candidate Unlock fee.

6.3 Employers acknowledge that they access candidate data as independent data controllers under PDPL and bear full responsibility for processing such data lawfully.

6.4 Employers commit to using candidate data exclusively for direct recruitment purposes. Selling or sharing data with third parties, using it for any other purpose, or retaining it beyond the period permitted under PDPL are strictly prohibited.

7. Ownership

7.1 Platform Ownership

You acknowledge and agree that tanfidh alkhadamat almadarah Company Ltd. and its suppliers hold all rights, title, and interest in the App and all its components, including interfaces, algorithms, databases, designs, trademarks, source code, and all aggregated data.

7.2 Trademarks

The "Shougl" mark and all associated logos and designs are owned by the Company and may not be used without explicit permission.

7.3 Employer Content

The Company does not claim ownership of your content. However, by publishing your job listings and business data on the platform, you grant the Company a full, irrevocable, worldwide, royalty-free, non-exclusive right to use that content for the purposes of operating and improving the Service.

7.4 Feedback

If you submit ideas, suggestions, or feedback about the App, you grant the Company an unlimited, irrevocable right to use such feedback in any form without any obligation to you.

8. User Conduct

You acknowledge and agree that you will not use the App for any of the following:

  • Violate intellectual property rights, privacy rights, or any other legal rights of third parties.
  • Post misleading, fraudulent, abusive, or inappropriate content.
  • Impersonate another entity or misrepresent your identity or business.
  • Tamper with the platform's systems or attempt to gain unauthorized access.
  • Introduce viruses, malicious code, or conduct cyber attacks of any kind.
  • Collect or scrape platform user data for unauthorized purposes.
  • Build a competing service or application using the platform's materials.
  • Violate Saudi Labor Law, PDPL, or any other applicable regulations.

9. Removal of Content

9.1 General

The Company reserves the right to remove or modify any content at its sole discretion and without prior notice. Content may be removed if it contains misleading, fraudulent, or abusive information, infringes intellectual property or privacy rights, violates Saudi labor regulations, or contains malicious files.

9.2 Job Posting Rules

The Company may remove a job posting in the following cases:

  • It violates Saudi Labor Law or contains legally prohibited discriminatory requirements.
  • It includes direct contact information or directs applicants to apply outside the platform.
  • It promotes products or services unrelated to recruitment.
  • It is for an expired position or does not reflect a genuine, active opportunity.
  • It is suspected of being linked to human trafficking or Kafala violations.

9.3 Reporting

The Company reserves the right to report any suspected unlawful activity to the relevant Saudi authorities. Related content may be shared with government or regulatory bodies as required by law.

10. Interactions with Candidates

10.1 Employer Responsibility

The Company is not a party to any employment relationship or dispute arising between the Employer and candidates. You are fully responsible for all your interactions with candidates and for recruitment decisions based on their data.

10.2 Content Provided by Candidates

Candidate data and content are outside the Company's control and responsibility. The Company makes no warranties as to the accuracy or completeness of candidate-provided information.

10.3 No Authentication of Candidates

The platform does not fully verify the identity of candidates; it is therefore your responsibility to conduct the necessary verification before engaging any candidate. By accepting these Terms, you release the Company and its employees from any claims arising from your interactions with candidates.

11. Third-Party Services

11.1 Third-Party Services

The App may contain links to or integrations with third-party services. The Company does not monitor these services and bears no responsibility for them. Shougl's Terms cease to apply once you leave its platform for any external service.

11.2 Integrated Third-Party Offerings

Tools and services from third parties may be made available within the subscription to facilitate recruitment workflows. The Company acknowledges that it does not supply, manage, or bear liability for such offerings.

12. Messaging & Notifications

12.1 SMS & Notification Services

By registering and providing your phone number, you consent to receiving text messages and notifications from Shougl relating to: account management and follow-up, job posting and candidate application alerts, and fraud prevention and account security.

12.2 Carrier Charges

Shougl does not charge for its messaging services; however, standard messaging and data rates from your mobile carrier may apply.

12.3 Privacy

Information associated with messages — such as your phone number, message content, and timestamps — may be collected and used in accordance with the Privacy Policy.

13. Refund Policy

Due to the immediate digital nature of the platform's services, refund requests are generally not accepted once payment has been completed and the service activated. Exceptions apply in the following cases:

  • A documented technical error preventing access to the paid-for service.
  • A duplicate charge or an error in the payment amount.
  • Failure by the platform to activate the service despite successful payment completion.

Refund requests must be submitted within 7 days of the issue, accompanied by supporting evidence. The Company undertakes to issue a decision within 14 business days.

14. Disclaimers

The platform's services are provided on an "as is" basis without any express or implied warranties. The Company does not warrant the accuracy of information provided by candidates, the uninterrupted availability of the service, or the absence of technical errors. Your use of the App is entirely at your own risk.

15. Limitation of Liability

To the fullest extent permitted by law, the Company shall not be liable for any direct, indirect, incidental, consequential, or special losses arising from the use of, or inability to use, the App. In all cases, the Company's total liability shall be limited to the fees paid by the Employer during the calendar month immediately preceding the incident in question.

16. Indemnification

You agree to indemnify, defend, and hold harmless the Company and its employees, directors, and agents from any claims, losses, or legal costs arising from: your violation of these Terms, your misuse of the App, your infringement of a third party's rights, or your non-compliance with applicable regulations.

17. Termination & Account Deletion

17.1 The Company reserves the right to terminate or suspend your account immediately in the event of a breach of these Terms, misuse of candidate data, violation of applicable regulations, or non-payment of outstanding fees.

17.2 You may terminate your account at any time via: Profile > Legal > Delete Account, or by contacting the support team. Prepaid fees are non-refundable except as provided in the Refund Policy above.

17.3 Please refer to the Privacy Policy for details regarding data retained after account deletion in accordance with legal requirements.

18. Governing Law & Dispute Resolution

This Agreement is governed by and shall be construed in accordance with the laws and regulations of the Kingdom of Saudi Arabia. The parties shall first seek amicable resolution within 30 days of written notice. If amicable resolution is not achieved, the dispute shall be referred to the competent courts of the Kingdom of Saudi Arabia.

19. Amendments

The Company reserves the right to amend these Terms at any time. Users will be notified of material changes via an in-app notice or to their registered email address. Continued use of the App constitutes acceptance of the amended Terms.
